• You agree not to upload garments or materials that are offensive, illegal, or infringe on third-party rights.

3. Accounts, Credits, and Payments

• Access to certain features of the Service may require you to create an account and purchase credits or a subscription.
• Credits or subscription fees are generally non-refundable, except as outlined in our Refund Policy.
• We reserve the right to modify pricing for credits, subscriptions, or any part of the Service with reasonable notice.
• All payments are processed securely through our designated payment providers. You agree to provide accurate and complete payment information.

4. Intellectual Property

Our Intellectual Property: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Create AI Models and its licensors. This includes our AI models, software, and platform design.

Your Intellectual Property: You retain all ownership rights to the garment images and other content you upload to the Service ("User Content").

5. User Content and Generated Images

• You grant Create AI Models a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your User Content (garment images) solely for the purpose of providing and improving the Services. This includes generating AI model imagery featuring your garments.
• You are responsible for ensuring you have all necessary rights and permissions for the User Content you upload.
• You may use the AI-generated model images featuring your garments for your e-commerce product showcasing and related promotional activities, subject to these Terms.
• You must not upload User Content that is illegal, obscene, defamatory, infringing on intellectual property rights, or otherwise harmful.
• We reserve the right, but not the obligation, to review and remove User Content or generated images that violate these Terms or that we deem inappropriate.

6. Service Modifications and Availability

We reserve the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time, with or without notice, for reasons including but not limited to maintenance, improvement, or unforeseen circumstances. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Create AI Models shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.

8. Indemnification

You agree to defend, indemnify and hold harmless Create AI Models and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) User Content posted on the Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
